FAQs
Frequently asked questions
Unsure about how we work? We have gathered the most common questions for your convenience.
The biggest issues often arise after the investigation has started, not when the engagement is first signed. A client may assume the investigator will handle matters outside the agreed remit, share a report more widely than expected, or rely on findings for purposes the consultancy did not intend. Sensitive witness material and personal data can also create tension if confidentiality and information handling are not clearly addressed. Stronger terms help set boundaries, but the legal position still depends on how the investigation is actually run in practice.
They usually cover the scope of the investigation, who can give instructions, what information the client must provide, confidentiality expectations, data handling, ownership of notes and reports, who may rely on the final report, liability wording and how the engagement can end. Depending on your model, the terms may also address conflicts, use of associates, assumptions made during the investigation and whether recommendations are included. These points matter because investigation work often involves sensitive allegations, internal documents and evidence from multiple individuals.
We look at the kinds of investigations you take on, who performs them, how evidence is gathered, whether you use subcontractors or associates, and how reports are delivered to clients. The drafting may differ if your work involves misconduct allegations, grievance matters, whistleblowing concerns or broader culture reviews. We also consider how information is stored and shared. Useful drafting usually starts with the real working model, then turns that into clear obligations and risk settings, rather than simply applying generic consultancy terms to every engagement.
Often not. General consultancy terms may say very little about witness confidentiality, limits on report reliance, handling of interview notes or the assumptions behind factual findings. Those gaps can matter if the client later uses the report in a disciplinary process or shares it beyond the intended audience. A more specific document can better reflect the realities of investigation work and the sensitivity of the material involved. The work can strengthen your position on the issue in scope, but it cannot account for every operational fact outside the materials provided.
Straightforward matters are often turned around within about 5 to 7 business days once we have your current terms, engagement materials and enough detail about your services. Timing can be longer if your consultancy has several service lines, uses multiple delivery models or wants substantial changes to existing wording. We will review the background documents, prepare a draft or mark-up, and work through the included amendment round. If later support is needed for a live dispute or a wider document suite, that would usually be scoped separately.
