FAQs

Frequently asked questions

Unsure about how we work? We have gathered the most common questions for your convenience.

The main risk is usually not the name of the document or process, but how it applies to your actual business setup. Trouble often starts when the paperwork does not say clearly when commission is earned, whether management approval is needed, how cancelled sales are treated, or what happens if a person leaves before the payment date. If those points are spread across offer letters, emails and spreadsheets, it becomes harder to work out which rule applies. A clear commission agreement brings those issues into one document and makes the intended structure easier to follow.

It will usually cover who is eligible for commission, how it is calculated, when it is treated as earned, and when it is paid. Many businesses also need wording on thresholds, caps, team sales, split credit, refunds, bad debt, discretionary adjustments, approval steps and record keeping. Leaver provisions are often important too, especially where a sale is signed before departure but payment falls due later. The practical working model can be just as important as the contract wording, so the document should reflect how sales are actually generated and credited.

The best approach depends on how the parties work together, what has already been agreed and where the main risks sit. We may need to know whether commission applies to employees, contractors or both, whether sales are individual or team based, how deals are approved, and when revenue is recognised internally. Existing contracts, offer letters, bonus policies and historic commission communications can matter as well. If the business uses different rules for different roles, that may affect whether one document is enough or whether separate wording is more practical.

Templates can be useful for structure, but commission arrangements are often more specific than they first appear. A generic form may not deal properly with split deals, clawbacks after refunds, probation periods, discretionary overrides or the position when someone moves role mid-quarter. Those are often the points that trigger disagreement later. Tailored drafting is usually more helpful where commission forms a meaningful part of pay or where your business has several sales channels, because the wording can be aligned to how the incentive model actually operates.

Not always. A business may want similar commercial outcomes across both groups, but the wording should reflect the real relationship and the surrounding documents. In some cases, using the same form for everyone can create confusion about status, entitlements or how the incentive is meant to operate. We can advise on the agreement wording itself and whether separate versions are sensible. Tax advice is not part of this service, and if a broader status review or dispute issue arises, that would need separate support.
